Terms and Conditions

  1. Services: Contractor shall provide Client with the following service (herein known as “Services”): Staging as outlined in the invoice provided to Client.

  2. Payment Details: Contract is considered valid under the following terms and conditions. For the services provided by Contractor under this Agreement, the Customer will pay Contractor compensation in full upon receipt of invoice for services rendered. The agreed upon amount for all-inclusive staging services including all furniture and accessories listed in invoice will be billed to Client every four weeks that the staging remains in home. No refunds will be given. Time will begin on the day staging is completed. The term of this agreement will begin on the date of this Agreement and will remain in full force until the completion of services on the De-Staging Day or before, upon successful sale of the property.

  3. Late Fees: Delinquent Payment: After 14 days from the due date each month, Client shall pay a late charge of $35.00. Any payment which is 15 days delinquent shall automatically terminate this agreement, and Contractor shall be immediately entitled to retake possession of furniture and accessories used in this staging service.

  4. Engagement: The Client hereby agrees to engage Contractor to provide the Client with staging services, although proven to be effective, is a trained professional opinion and services provided do not in any way warranty or guarantee the sale of the home. The Client acknowledges before and after photographs will be taken during the Staging process and gives permission to Contractor use of these photographs in advertising and marketing. The furniture and accessories herein shall be kept on the property and shall not be moved off premises. The Client grants Contractor employee's permission to enter and use the property for the purpose of providing Home Staging Services. Entry to the premises must be made available to Contractor by way of providing a key, combination to lock box or Supra access. Client acknowledges Contractor has permission to move anything within the property, as well as permission to put holes in the walls for artwork, etc. Touch-ups are not the responsibility of Contractor.

  5. Property Readiness: Client agrees to have property "Stage Ready", completing within reason the tasks listed in the Staging Consultation notes given at the initial consultation unless property is completely vacant. Client agrees to have property thoroughly cleaned prior to staging. There is a 10% restocking fee if property is not Stage Ready at arrival. Climate Control: Client agrees to maintain the property at a salable temperature throughout the time this agreement is in force. Summer cooling temperatures will be maintained between 75 degrees Fahrenheit and 78 degrees Fahrenheit. Winter heating temperatures will be maintained between 65 degrees Fahrenheit and 70 degrees Fahrenheit. Staging service will not be performed in uncomfortable climate conditions. Failure to ensure proper climate control may result in the delaying of the staging project resulting in additional fees. Delay of Service fees will not be waived.

  6. Furniture and Accessory Rental: Client acknowledges receipt of the furniture and accessories in good condition by accepting delivery. Furniture and accessories remaining on the property are the direct responsibility of the Client. All items are to be returned in the same condition, as when placed, otherwise replacement costs will be added to the invoice. Client agrees that the staging design style and layout is at the professional stager's discretion and any changes requested by the client will be charged at $150 per hour. Client acknowledges the stager may leave business cards/brochures at the home. Contractor has the right to enter premises during the duration of the staging for the purpose of checking on staging props, refreshing items and condition. Client agrees that no painting, remodeling work or pest treatment while staging items are in the house is permitted without written approval of Contractor. Client agrees that any pets in the home will be closely monitored while staging items are in the house. Any damage to items will result in replacement costs added to the invoice. Client agrees that if a petition of bankruptcy is filed by or against customer, or a receiver is appointed, Contractor may declare this agreement terminated and without notice or demand, or process of law, take the possession of the furniture and accessories wherever located. Client shall pay all cost of locating and repossessing the furniture if the agreement is violated. Client agrees that if a lawsuit is brought to collect money under this agreement, customer shall pay all court cost, including attorney's fees, as the court shall determine. If court proceedings are filed, Contractor may file for the then delinquent staging service fees plus fees for any damages to furniture and accessories. In the event the Client is in violation of any terms of this agreement, Contractor shall have immediate right to remove the furniture and accessories from said premises.

  7. Notice: Parties shall provide effective notice (“Notice”) to each other, including any payments or invoices, via either email or postal mail at the date and time which the Notice is sent.

  8. Termination: Either party may terminate this Agreement upon written notice to the other party. In the event of termination, Homeowner agrees to pay Home Stager for all services rendered up to the date of termination.

  9. Severability: If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force, if the essential provisions of this Agreement for each party remain legal and enforceable.

  10. Amendments: The parties may amend this Agreement only by the parties’ written agreement with proper Notice.

  11. Assignments: Neither party may assign or subcontract any rights or obligations in this Agreement without proper Notice, unless otherwise provided herein.

  12. Titles: The titles and section headers in this Agreement are provided for convenience only and should not be construed as part of this Agreement.
